Membership Agreement
This Membership Agreement ('Agreement') is the contractual framework intended for a future Seller membership service. Its publication does not state that production membership, seller billing, payment integrations or Buyer transactions are currently open.
The Agreement becomes binding on a Seller only if FaStart expressly opens production membership and presents this Agreement for electronic acceptance during that process. Reading this public page or joining a waitlist is not acceptance.
Only the policy versions identified in the production acceptance record or executed order form form part of an activated Agreement. Roadmap, demo, preorder and marketing material does not expand the contracted service scope.
1. Parties and Subject
1.1. The parties to this Agreement are FaStart Teknoloji A.Ş. ('FaStart' or 'Company'), with its registered office at Cumhuriyet Mah. Şişecam Yolu Sk. Ar-Ge G3 No: 28, Gebze/Kocaeli, Türkiye, and the natural or legal person who becomes a member of the FaStart platform as a Seller ('Seller' or 'Member').
1.2. The subject of the Agreement is to determine the conditions for any SaaS e-commerce function expressly activated for the Seller in the future. This public text does not make a production service available.
1.3. This Agreement cannot be amended by a unilateral declaration of Members; amendments are subject solely to the procedure specified in Article 10.
2. Definitions
FASTART: The website operated by FaStart Teknoloji A.Ş. at the domain www.fastart.co and subdomains of myfastart.co is referred to as 'FaStart' or 'Platform'.

BUYER: A natural or legal person who purchases products from a Seller's store on FaStart.
STORE: An online storefront that may be activated for a Seller under an executed service scope. Custom-domain mapping remains roadmap unless expressly enabled and documented.

POS INTEGRATION: A third-party payment service that may be connected only after FaStart makes the integration available and verifies it for the Seller. No provider is represented as connected or live today.
COMMISSION: A fee that may apply only if its rate, tax treatment, calculation basis and collection method are stated in an executed Seller order form after production billing is activated.
SUBSCRIPTION FEE: A platform fee that may apply only under a production subscription expressly accepted by the Seller. Public preorder pricing is not an active recurring charge.
3. Membership Conditions
3.1. To become a member of FaStart, natural persons must be over 18 years of age and have full legal capacity; legal persons must act through authorized representatives.
3.2. The Seller is obliged to provide accurate, up-to-date and complete information during the membership application and account management. The Seller is responsible for any consequences arising from incorrect or incomplete information.
3.3. Each Seller may create only one account. Account information is personal and may not be shared with third parties.
3.4. The Seller is personally responsible for account security (password, access credentials, etc.). The Seller is held responsible for all transactions performed through the account.
3.5. If production membership is opened, the Company may accept, reject, suspend or terminate membership subject to this Agreement and applicable law. This clause does not represent account administration as live today.
4. Platform Services
FaStart is developing SaaS e-commerce infrastructure. A function is provided under this Agreement only when expressly activated for the Seller; the list below does not convert demo or roadmap material into a live service.
4.1. Services Provided by FaStart:
- Storefront and management functions expressly marked as activated in the production product
- Theme and customization functions expressly activated for the Seller
- Payment, shipping and marketplace integrations only after the relevant provider connection is made available and verified
- Analytics only after a production data source is connected; fictional dashboard data is not a production service
- Email or SMS automation only after expressly activated
- Marketing-site response headers and the security.txt contact are verified; product authentication, merchant RBAC, audits and certifications are not promised
- Support through the channels and service levels expressly included in the executed service scope
4.2. Services NOT Provided by FaStart:
- Payment collection unless and until a verified provider is expressly activated. Any future provider flow is governed by the transaction disclosure and provider terms; this Agreement does not activate one.
- Shipping and logistics: Packaging, shipping and delivery of products is entirely the Seller's responsibility.
- Product quality guarantee: FaStart provides no guarantee regarding the quality, accuracy, safety or regulatory compliance of products offered for sale by Sellers.
- Seller-Buyer dispute resolution: Sales, returns and customer service are directly the Seller's obligation.
5. Pricing and Payment
5.1. Subscription Fee: Core, Flow, Reach, Scale and Ultra currently appear as planned preorder packages; no public self-serve paid subscription is represented as active. A fee arises only from an executed order form or production checkout that states the fee, taxes and billing interval.
5.2. Commission: A commission may apply only if an executed order form states the channel, rate, tax treatment, calculation basis and collection method. Public marketing copy and sample calculations do not create a charge.
5.3. Payment Method: No seller-card billing integration is represented as live. If production billing is activated, the accepted order form and payment-provider disclosure will identify the authorized payment method.
5.4. Commission Collection: No automatic commission calculation or card collection is represented as live. Any future collection schedule and threshold must be expressly accepted before it applies.
5.5. Failed Payment: Account suspension for failed automated collection does not apply unless production billing and account administration have first been activated and the executed agreement states the notice and remedy process.
5.6. Service Fee Terms are conditional future terms and apply only when incorporated into an executed order form after production billing is activated.
5.7. Any future fee currency, rate change and notice period will be stated in the executed agreement and handled through a communication channel actually available to the Seller.
Important Notice About Payments
There is no verified live Buyer-payment provider or Seller billing integration today. If either is activated in the future, the executed Seller terms and transaction disclosure—not this public page—will define the parties, amounts and collection method.
6. Seller Obligations
The Seller agrees and undertakes to comply with the following obligations when using the FaStart platform:
- Provide accurate, complete and up-to-date information in product listings; not use misleading prices, descriptions or images.
- Comply with the Turkish Commercial Code No. 6102, the Consumer Protection Law No. 6502, the Law on Regulation of Electronic Commerce No. 6563, the Tax Procedure Law No. 213 and all related legislation.
- Personally fulfill financial obligations such as tax liability, invoice issuance and tax return filing. FaStart bears no responsibility for the Seller's tax obligations.
- Provide timely and adequate customer service to Buyers; manage complaints, returns and exchange requests in accordance with legislation.
- Ship orders on time and in full; communicate shipping tracking information to Buyers.
- If production billing is later activated, maintain the authorized payment method required by the executed order form.
- Not offer for sale products specified in FaStart's Prohibited Products list and Listing Rules.
- Refrain from actions that jeopardize platform security; not disrupt the platform's technical infrastructure or engage in reverse engineering.
- Not share account information with third parties and ensure account security.
7. Intellectual Property Rights
7.1. The entire FaStart platform, including software code, design, interface, database structure, logos, trademarks and all visual/textual content, is the exclusive intellectual property of the Company or is licensed by the Company.
7.2. The Seller retains intellectual property rights over product images, descriptions and similar content uploaded to their store. The Seller warrants that such content does not infringe third-party rights.
7.3. For the term of the activated service, the Seller grants FaStart a non-exclusive, worldwide, royalty-free license limited to hosting, reproducing, adapting for technical formats, transmitting and displaying uploaded content as necessary to provide and secure the service. Promotional use outside the Seller's own storefront requires separate permission. The license ends when the content is deleted, subject to backups, legal retention and completed transaction records.
8. Privacy and Data Protection
8.1. Any Seller personal-data processing is limited to the current KVKK Privacy Notice and applicable law. This Agreement does not certify database encryption, role-based access control or any other unverified product control.
8.2. Production membership must present the applicable privacy notice and legal basis before collecting Seller data. Joining a waitlist or reading this public Agreement does not consent to unrelated future product processing.
8.3. The Seller may use Buyers' personal data solely for order fulfillment purposes; they may not share such data with third parties and must comply with KVKK obligations.
9. Limitation of Liability
9.1. FaStart is a platform service provider. It is not a party to the sales relationship established between the Seller and the Buyer. FaStart bears no responsibility in disputes between Sellers and Buyers (product quality, returns, incomplete delivery, etc.).
9.2. If a payment provider is activated in the future, responsibility for errors, refunds and chargebacks will be allocated by the executed agreement, transaction disclosure and provider terms. No connected provider is represented today.
9.3. FaStart cannot be held responsible for delays, losses, damages or delivery issues during the shipping process.
9.4. To the extent permitted by applicable law, FaStart's aggregate liability under this Agreement is limited to service fees collected from the Seller during the 12 (twelve) months preceding the event, and FaStart is not liable for indirect, incidental, special or punitive damages. These limits do not apply to intent, gross negligence, death or personal injury, mandatory consumer rights, breach of confidentiality or data-protection duties to the extent they cannot lawfully be limited, or another non-excludable liability.
9.5. The Company cannot be held liable for failure to fulfill its obligations due to force majeure (natural disasters, war, strikes, epidemics, government decisions, internet infrastructure failures, cyber attacks, etc.). Obligations are suspended during the force majeure period.
10. Agreement Amendments
10.1. The Company may amend an activated Agreement subject to applicable law and the notice period stated in that Agreement. Notice will use a channel actually available to the Seller; this clause does not represent a registered-user notification workflow as live.
10.2. Where law permits acceptance by continued use, a Seller that continues after the notified effective date is bound by the amendment and may terminate beforehand. A material change to price, essential service scope, data-processing role or another term requiring explicit acceptance applies only after the required acceptance is recorded.
11. Termination
11.1. FaStart may suspend access immediately where reasonably necessary to address illegality, prohibited products, security risk, fraud, harm to third parties or an urgent legal duty. For a remediable breach, FaStart will provide reasonable notice and an opportunity to cure before termination unless law, safety or the severity of the breach makes that inappropriate.
11.2. After production membership and billing are activated, the Seller may terminate through the method and effective date stated in the executed agreement. No current self-serve account-closure or subscription-cancellation workflow is represented here.
11.3. The following consequences arise in case of termination:
- The Seller's store is deactivated and public access is closed.
- Retention and deletion of production Seller data will follow the privacy notice and controls presented for the activated service; this public Agreement does not assert an implemented product-retention workflow.
- Any amounts validly accrued under an executed agreement remain payable through the collection method stated there; no automatic registered-card charge is represented as live.
- The Seller has the right to export their product data before the termination date.
12. Governing Law
Turkish law applies to this Agreement. Subject to mandatory jurisdiction rules and consumer rights, the Courts and Enforcement Offices of Kocaeli have jurisdiction over disputes arising from this Agreement.
13. Effective Date
13.1. This Agreement enters into force for a Seller only if a production membership process presents it for electronic approval and records that approval. Public publication, waitlist registration or demo use is not acceptance.
13.2. This Agreement was published on 11.08.2026. It is not binding on a Seller until the activation and acceptance conditions above are met.
This Membership Agreement is a future-service framework and is not binding until the activation and electronic-acceptance conditions above are satisfied. For questions, please contact legal@fastart.co.
