1. Introduction
These terms govern use of FaStart's public marketing website. They do not create a Seller account, Buyer transaction, paid subscription or production product agreement. Any future commercial service requires a separate, completed agreement or checkout presented through an activated production flow.
2. Parties and Subject
2.1. FaStart Teknoloji A.Ş., with its registered office at Cumhuriyet Mah. Şişecam Yolu Sk. Ar-Ge G3 No: 28, Gebze/Kocaeli, Türkiye (the 'Company' or 'FaStart'), publishes this framework for visitors to the public website.
2.2. The current scope is the public website. Seller, Buyer and SaaS-product terms below are a future-service framework and apply only if incorporated into a separately accepted production agreement.
3. Definitions
FaStart: The FaStart brand, public website and developing SaaS e-commerce product family. Marketing demonstrations, roadmap descriptions and preorder pages do not establish production availability.
WEBSITE: The website consisting of the www.fastart.co domain and its associated sub-domains (*.myfastart.co).
STORE: An online storefront that may be made available to a Seller under an activated service scope. Custom-domain mapping remains roadmap and is not included unless expressly enabled and documented.
VISITOR: Any natural or legal person who accesses FaStart by any means. This definition also encompasses Member/Seller and User/Buyer definitions.
MEMBER / SELLER: A prospective natural or legal person who may become a Seller only after production membership is activated and a completed Seller agreement is accepted.
USER / BUYER: A prospective Buyer in a future activated Seller transaction. No Buyer checkout or transaction is created by visiting this website.
SERVICES: The SaaS functions expressly enabled for a Seller and identified in the production product or an accepted order form. A feature shown on a marketing, pricing or demo page is not part of the service until it is activated.
POS INTEGRATION: A third-party payment service that may be connected in the future only after FaStart makes the integration available and verifies it for the Seller. No POS provider is represented by these Terms as connected or live today.
CONTENT: Any text, images, graphics, video, data, software code and other materials present on or accessible through FaStart.
4. Potential Product Scope
FaStart is developing SaaS e-commerce infrastructure. The list below describes the service scope only where each function is expressly activated; roadmap, demo and preorder material does not create present availability.
Functions that may form part of an activated service:
- Online-store hosting and a sub-domain only if provisioned for the Seller
- Seller administration functions only where enabled in the production product
- Theme and store-customization functions only where enabled
- Analytics and reporting only where verified for the activated service
- Third-party payment, shipping and marketplace integrations only after the relevant integration is explicitly activated and verified
- The verified marketing-site response headers and published security.txt contact; no page-level CSP, product security certification or audit is promised
- Email and SMS automation only if expressly enabled in the production product
Services NOT Provided by FaStart:
- Payment processing services unless and until a verified third-party provider is expressly activated for the Seller; these Terms do not make a provider available
- Product quality assurance (The quality, suitability and legal compliance of products offered for sale are entirely the Seller's responsibility)
- Shipping and logistics services (Packaging, dispatching and delivery of products are the Seller's responsibility)
- Direct payment collection from Buyers; any future provider flow will be governed by the connected provider's terms and the transaction disclosure shown to the Buyer
5. Public Website and Conditional Product Terms
5.1. Visitors must have legal capacity to use the public website. Any future commercial account may impose additional age, authority and eligibility checks in its executed agreement.
5.2. Information submitted through current public forms must be accurate and complete. Future Member and Buyer obligations apply only after the relevant production agreement is accepted.
5.3. No content that is unlawful, misleading, insulting, threatening, contrary to public morality, or that infringes the rights of third parties may be published on FaStart.
5.4. If production Seller publishing is activated, the executed Seller terms must allocate responsibility for product legality, quality and safety; this clause does not represent live Seller listings.
5.5. Users may not engage in any activity that would damage the technical infrastructure of FaStart, interfere with the normal operation of the system, or jeopardize platform security.
6. Unacceptable Use
- Accessing any part of FaStart or collecting data using automated tools (bots, scrapers, crawlers, etc.)
- Reverse engineering, decompiling or copying the source code of FaStart
- Attempting to bypass, disable or test the platform's security mechanisms
- Uploading viruses, trojans, malware or any malicious code to FaStart infrastructure
- Using FaStart's features, content or data to develop a competing service
- Preventing other users from using FaStart or deliberately degrading platform performance
- Reproducing or distributing platform content for commercial purposes without FaStart's express written permission
7. Intellectual Property Rights
7.1. Intellectual property rights to the software code, database, interface design, user experience (UI/UX), graphics, logos and all original content of the FaStart platform belong to FaStart Teknoloji A.Ş. and/or are used by the Company under legally valid licenses.
7.2. If production uploads are activated, Sellers retain their rights to original product images, descriptions and brand elements and must have the rights required to upload them.
7.3. No production-content license arises from this public page. Any future limited license for storing, transmitting or displaying Seller content must be stated in the Seller agreement accepted before upload.
8. Service Availability
8.1. The public website and any future activated service may experience interruptions or errors. Service levels, maintenance commitments and remedies exist only where stated in an executed agreement.
8.2. Where a production service is activated, planned maintenance notices will use a communication channel actually available to the affected Seller. This clause does not represent a seller dashboard or registered-user email workflow as live.
8.3. The Company cannot be held responsible for service interruptions caused by reasons beyond FaStart's control, including force majeure events.
9. Force Majeure
In all circumstances legally considered force majeure, the Company shall not be liable for late performance or non-performance of its obligations arising from these Terms of Use. Natural disasters, war, riots, strikes, epidemics, government decisions, communication problems, infrastructure and internet failures, power outages, cyber attacks and similar extraordinary events are considered force majeure.
10. Governing Law
Turkish law shall apply to the implementation, interpretation and management of legal relations arising under these Terms of Use. The courts and enforcement offices of Kocaeli shall have exclusive jurisdiction over any disputes arising from or in connection with these Terms of Use.
11. Effective Date
11.1. The public-website rules in this document apply when published and made available to a visitor, subject to applicable law. Publication does not activate or obtain acceptance of future Seller, Buyer, billing or transaction terms.
11.2. These public website terms took effect on 11.08.2026. Production merchant or buyer services apply only when their service-specific terms are presented and accepted as required.
