Membership Agreement

This Membership Agreement ('Agreement') governs the rights and obligations between Sellers who register as members on the FaStart platform and FaStart Teknoloji A.S. Please read this Agreement carefully before using the Platform.

By completing the membership process, you are deemed to have declared that you have read, understood and accepted all provisions of this Agreement. If you do not accept the terms of the Agreement, do not complete the membership process.

For matters not covered in this Agreement, the Terms of Use, Service Fee Terms, KVKK Disclosure and other policy documents published on FaStart shall apply; these documents are integral parts of this Agreement.

1. Parties and Subject

1.1. The parties to this Agreement are FaStart Teknoloji A.S. ('FaStart' or 'Company'), located at Hacıhalil Mah. 1219. Sk. Nalbur İş Hanı No:8/305 Gebze/Kocaeli, Turkiye, registered with Gebze Trade Registry Office under registry number 46958, MERSIS No: 0385215794800001, and the natural or legal person who becomes a member of the FaStart platform as a Seller ('Seller' or 'Member').

1.2. The subject of the Agreement is the determination of the conditions regarding the Seller's use of the SaaS e-commerce platform services provided through the domain www.fastart.co and subdomains of myfastart.co by the Company.

1.3. This Agreement cannot be amended by a unilateral declaration of Members; amendments are subject solely to the procedure specified in Article 10.

2. Definitions

FASTART: The website operated by FaStart Teknoloji A.S. at the domain www.fastart.co and subdomains of myfastart.co is referred to as 'FaStart' or 'Platform'.

WEBSITE: The website consisting of the domain www.fastart.co and its subdomains (*.myfastart.co), where Sellers host their stores and Buyers can view products.

SERVICES: All SaaS e-commerce platform services offered by FaStart to Sellers, including store hosting, management panel, themes, integrations, analytics and support.

MEMBER / SELLER: A natural or legal person who registers as a member of FaStart and offers products and/or services for sale through the platform.

BUYER: A natural or legal person who purchases products from a Seller's store on FaStart.

STORE: The online sales storefront created by the Seller on the FaStart platform, accessed via a store.myfastart.co subdomain or custom domain.

PRODUCT: Any goods and/or services offered for sale by the Seller through their store.

POS INTEGRATION: The third-party payment service provider that the Seller connects to the FaStart platform to collect payments from Buyers (iyzico, Stripe, etc.).

COMMISSION: The percentage service fee, including VAT, paid to the Company on successful sales made through the Seller's store.

SUBSCRIPTION FEE: The fixed monthly platform usage fee charged according to the plan selected by the Seller.

3. Membership Conditions

3.1. To become a member of FaStart, natural persons must be over 18 years of age and have full legal capacity; legal persons must act through authorized representatives.

3.2. The Seller is obliged to provide accurate, up-to-date and complete information during the membership application and account management. The Seller is responsible for any consequences arising from incorrect or incomplete information.

3.3. Each Seller may create only one account. Account information is personal and may not be shared with third parties.

3.4. The Seller is personally responsible for account security (password, access credentials, etc.). The Seller is held responsible for all transactions performed through the account.

3.5. The Company reserves the right to accept or reject membership applications and to suspend or terminate membership without providing a reason.

4. Platform Services

FaStart is a platform service provider that offers e-commerce infrastructure to Sellers on a SaaS model. The services provided and not provided within the scope of the Platform are specified below.

4.1. Services Provided by FaStart:

  • Seller store hosting (subdomain: store.myfastart.co or custom domain support)
  • Seller management panel (product, order, customer management)
  • Mobile-responsive store themes and theme customization tools
  • POS integration (connecting the Seller's own POS provider)
  • Shipping integrations
  • Analytics and reporting tools
  • Email and SMS automation tools (plan-dependent)
  • Marketplace integrations (plan-dependent)
  • Technical infrastructure, SSL certificate and security
  • Support services (AI-powered 24/7 and priority support by plan)

4.2. Services NOT Provided by FaStart:

  • Payment collection: Buyers pay directly through the POS provider connected by the Seller. FaStart does not in any way collect, mediate or hold Buyer payments in escrow.
  • Shipping and logistics: Packaging, shipping and delivery of products is entirely the Seller's responsibility.
  • Product quality guarantee: FaStart provides no guarantee regarding the quality, accuracy, safety or regulatory compliance of products offered for sale by Sellers.
  • Seller-Buyer dispute resolution: Sales, returns and customer service are directly the Seller's obligation.

5. Pricing and Payment

5.1. Subscription Fee: FaStart offers different plan options. The free plan is TRY 0/month and the Pro plan is TRY 2,999/month. For current plan fees and features, the pricing page (www.fastart.co/pricing) shall prevail. The Company may change subscription fees upon prior notice.

5.2. Commission: FaStart charges a commission on successful sales made through the Seller's store. Commission rates are: Free plan 4.9%, Pro plan 2.9%, VAT included. Commission applies only to sales made through the Seller's own store.

5.3. Payment Method: Both subscription fees and commission fees are charged to the credit card registered by the Seller. The Seller is obliged to maintain a valid payment method.

5.4. Commission Collection: Commission fees are calculated cumulatively and charged to the Seller's registered credit card when the threshold amount set by the Company is reached or at the determined period.

5.5. Failed Payment: If collection cannot be made from the registered credit card, the Company notifies the Seller. If payment is not made within 7 (seven) days following the notification, the Company reserves the right to suspend the Seller's account and/or temporarily close the store.

5.6. Detailed terms, calculation examples and special cases regarding pricing are set forth in the Service Fee Terms document.

5.7. All prices and commission rates are in Turkish Lira. The Company announces pricing changes at least 30 (thirty) days in advance via the Platform and/or email.

Important Notice About Payments

FaStart does not collect payments from Buyers. Buyers pay directly through the POS provider connected by the Seller. The amounts collected by FaStart from the Seller consist solely of subscription fees and commission fees.

6. Seller Obligations

The Seller agrees and undertakes to comply with the following obligations when using the FaStart platform:

  • Provide accurate, complete and up-to-date information in product listings; not use misleading prices, descriptions or images.
  • Comply with the Turkish Commercial Code No. 6102, the Consumer Protection Law No. 6502, the Law on Regulation of Electronic Commerce No. 6563, the Tax Procedure Law No. 213 and all related legislation.
  • Personally fulfill financial obligations such as tax liability, invoice issuance and tax return filing. FaStart bears no responsibility for the Seller's tax obligations.
  • Provide timely and adequate customer service to Buyers; manage complaints, returns and exchange requests in accordance with legislation.
  • Ship orders on time and in full; communicate shipping tracking information to Buyers.
  • Maintain valid credit card information in the system at all times.
  • Not offer for sale products specified in FaStart's Prohibited Products list and Listing Rules.
  • Refrain from actions that jeopardize platform security; not disrupt the platform's technical infrastructure or engage in reverse engineering.
  • Not share account information with third parties and ensure account security.

7. Intellectual Property Rights

7.1. The entire FaStart platform, including software code, design, interface, database structure, logos, trademarks and all visual/textual content, is the exclusive intellectual property of the Company or is licensed by the Company.

7.2. The Seller retains intellectual property rights over product images, descriptions and similar content uploaded to their store. The Seller warrants that such content does not infringe third-party rights.

7.3. The Seller is deemed to have granted the Company a perpetual, non-exclusive, irrevocable, royalty-free license to display, use and distribute content uploaded to their store on the FaStart platform and in promotional materials.

8. Privacy and Data Protection

8.1. The Seller's personal data is processed within the scope of the Personal Data Protection Law No. 6698 ('KVKK') and related legislation. Detailed information about the purposes, scope and rights regarding data processing is provided in the KVKK Disclosure.

8.2. By using the FaStart platform, the Seller consents to the processing of their personal data for the purpose of performing the Agreement and providing Platform services.

8.3. The Seller may use Buyers' personal data solely for order fulfillment purposes; they may not share such data with third parties and must comply with KVKK obligations.

9. Limitation of Liability

9.1. FaStart is a platform service provider. It is not a party to the sales relationship established between the Seller and the Buyer. FaStart bears no responsibility in disputes between Sellers and Buyers (product quality, returns, incomplete delivery, etc.).

9.2. FaStart is not responsible for payment issues, transaction errors, refunds or chargeback transactions arising from the POS provider connected by the Seller.

9.3. FaStart cannot be held responsible for delays, losses, damages or delivery issues during the shipping process.

9.4. FaStart's total liability under this Agreement is in any case limited to the total service fees collected from the Seller in the 12 (twelve) month period preceding the month in which the relevant event occurred. FaStart is not liable for indirect, incidental, special or punitive damages.

9.5. The Company cannot be held liable for failure to fulfill its obligations due to force majeure (natural disasters, war, strikes, epidemics, government decisions, internet infrastructure failures, cyber attacks, etc.). Obligations are suspended during the force majeure period.

10. Agreement Amendments

10.1. The Company may amend the provisions of this Agreement by notification through the Platform and/or by sending a notification to the Seller's registered email address. Amendments take effect 30 (thirty) days after the announcement date.

10.2. The Seller is deemed to have accepted the amendments by continuing to use the Platform after the effective date of the amendments. A Seller who does not accept the amendments has the right to terminate the Agreement before the effective date.

11. Termination

11.1. The Company may suspend the Seller's account or immediately terminate the Agreement without prior notice if the Seller violates the provisions of this Agreement or Platform rules, fails to fulfill payment obligations, sells prohibited products or acts in violation of legislation.

11.2. The Seller may terminate the Agreement at any time by closing their account and/or canceling their subscription. Termination takes effect at the end of the current billing period.

11.3. The following consequences arise in case of termination:

  • The Seller's store is deactivated and public access is closed.
  • Data belonging to the Seller is stored for the periods prescribed by KVKK and related legislation; thereafter it is destroyed.
  • Commission fees accrued up to the termination date and any unpaid subscription fees are charged to the Seller's registered credit card.
  • The Seller has the right to export their product data before the termination date.

12. Governing Law

Turkish law shall apply to the implementation, interpretation and management of legal relations arising from this Agreement. The Courts and Enforcement Offices of Kocaeli shall have exclusive jurisdiction for any disputes arising from or that may arise from this Agreement.

13. Effective Date

13.1. This Agreement enters into force upon the Seller's electronic approval during the membership process. All policy documents, warnings and disclosures published on FaStart are integral parts of this Agreement.

13.2. This Agreement took effect on 23/02/2026 and is valid for all Sellers as of that date.

This Membership Agreement is binding for all users operating as Sellers on the FaStart platform. For questions about the Agreement, please contact our support team.
