Terms of Use

1. Introduction

By accessing, visiting and/or using the FaStart website (www.fastart.co) and its associated sub-domains (including myfastart.co), you are deemed to have read, understood and accepted these Terms of Use in full as an inseparable whole. If you do not accept these terms, please do not visit and/or use FaStart.

2. Parties and Subject

2.1. One party to these Terms of Use is FaStart Teknoloji A.S., located at Hacıhalil Mah. 1219. Sk. Nalbur İş Hanı No:8/305 Gebze/Kocaeli, Turkiye, registered with Gebze Trade Registry Office under registry number 46958, MERSIS No: 0385215794800001 (hereinafter referred to as the 'Company' or 'FaStart'); the other party is all natural and legal persons who access FaStart as a Visitor, Member/Seller or User/Buyer.

2.2. The subject of these Terms of Use is to establish the conditions governing the use of the SaaS e-commerce platform services provided by FaStart via the www.fastart.co domain and myfastart.co sub-domains.

3. Definitions

FaStart: The SaaS e-commerce platform, all rights to which belong to FaStart Teknoloji A.S., consisting of the www.fastart.co main domain and myfastart.co sub-domains, where Sellers create and manage their online stores and Buyers can view and purchase products from those stores.

WEBSITE: The website consisting of the www.fastart.co domain and its associated sub-domains (*.myfastart.co).

STORE: The online storefront created by the Seller on the FaStart platform, accessible via a store.myfastart.co sub-domain or a custom domain.

VISITOR: Any natural or legal person who accesses FaStart by any means. This definition also encompasses Member/Seller and User/Buyer definitions.

MEMBER / SELLER: Natural or legal persons who create an account on FaStart, set up their own store, offer products and/or services for sale, and have accepted the Membership Agreement.

USER / BUYER: Any natural or legal person who purchases products and/or services from stores on FaStart.

SERVICES: All SaaS e-commerce platform services provided by FaStart to Sellers: store hosting, admin panel, theme system, analytics, integrations and support services.

POS INTEGRATION: The third-party payment service provider connected by the Seller to the FaStart platform to collect payments from Buyers (e.g. iyzico, Stripe).

CONTENT: Any text, images, graphics, video, data, software code and other materials present on or accessible through FaStart.

4. Platform Services

FaStart is a SaaS platform service that provides e-commerce infrastructure to Sellers. The services that FaStart does and does not provide are clearly stated below.

Services Provided by FaStart:

  • Online store hosting and sub-domain (store.myfastart.co)
  • Seller admin panel (product, order, customer management)
  • Theme system and store customization tools
  • Analytics and reporting dashboard
  • Third-party POS, shipping and marketplace integrations
  • SSL certificate and platform-level security
  • Email and SMS automation tools

Services NOT Provided by FaStart:

  • Payment processing services (Payments are processed through the Seller's own POS integration; FaStart does not act as a payment intermediary)
  • Product quality assurance (The quality, suitability and legal compliance of products offered for sale are entirely the Seller's responsibility)
  • Shipping and logistics services (Packaging, dispatching and delivery of products are the Seller's responsibility)
  • Direct payment collection from Buyers (Buyers pay the Seller directly through the Seller's POS)

5. Terms of Use

5.1. Users must be at least 18 years of age and have legal capacity to use FaStart.

5.2. Members and Users warrant that all information provided to FaStart is accurate, current and complete. Liability for inaccurate or incomplete information rests with the party providing it.

5.3. No content that is unlawful, misleading, insulting, threatening, contrary to public morality, or that infringes the rights of third parties may be published on FaStart.

5.4. Sellers are solely responsible for the legal compliance, quality and safety of the products and services they offer for sale in their stores.

5.5. Users may not engage in any activity that would damage the technical infrastructure of FaStart, interfere with the normal operation of the system, or jeopardize platform security.

6. Unacceptable Use
  • Accessing any part of FaStart or collecting data using automated tools (bots, scrapers, crawlers, etc.)
  • Reverse engineering, decompiling or copying the source code of FaStart
  • Attempting to bypass, disable or test the platform's security mechanisms
  • Uploading viruses, trojans, malware or any malicious code to FaStart infrastructure
  • Using FaStart's features, content or data to develop a competing service
  • Preventing other users from using FaStart or deliberately degrading platform performance
  • Reproducing or distributing platform content for commercial purposes without FaStart's express written permission

7. Intellectual Property Rights

7.1. Intellectual property rights to the software code, database, interface design, user experience (UI/UX), graphics, logos and all original content of the FaStart platform belong to FaStart Teknoloji A.S. and/or are used by the Company under legally valid licenses.

7.2. Sellers retain their rights to product images, descriptions, brand elements and other original content they upload to FaStart. The Seller warrants that the content they upload does not infringe the intellectual property rights of third parties.

7.3. For content uploaded to FaStart by Members and Users, a limited, non-exclusive, royalty-free license is deemed to have been granted to FaStart for the purpose of displaying, transmitting and storing such content in connection with providing the platform services.

8. Service Availability

8.1. FaStart does not guarantee that the platform will operate without interruption or error. Temporary service interruptions may occur due to technical maintenance, updates and infrastructure improvements.

8.2. Planned maintenance will be communicated in advance through the seller dashboard and/or email within a reasonable timeframe.

8.3. The Company cannot be held responsible for service interruptions caused by reasons beyond FaStart's control, including force majeure events.

9. Force Majeure

In all circumstances legally considered force majeure, the Company shall not be liable for late performance or non-performance of its obligations arising from these Terms of Use. Natural disasters, war, riots, strikes, epidemics, government decisions, communication problems, infrastructure and internet failures, power outages, cyber attacks and similar extraordinary events are considered force majeure.

10. Governing Law

Turkish law shall apply to the implementation, interpretation and management of legal relations arising under these Terms of Use. The courts and enforcement offices of Kocaeli shall have exclusive jurisdiction over any disputes arising from or in connection with these Terms of Use.

11. Effective Date

11.1. These Terms of Use become effective for all Visitors on the date they are announced within FaStart by the Company. Anyone who visits and/or uses FaStart is deemed to have accepted these Terms of Use.

11.2. These Terms of Use took effect on 23/02/2026 and are valid for all Visitors as of that date.
