2. Subject of the Agreement
- 2.1. This Agreement is drawn up in accordance with Article 48 of the Consumer Protection Law No. 6502 and the provisions of the Distance Contracts Regulation.
- 2.2. The subject of this Agreement is to determine the rights and obligations of the parties regarding the sale and delivery of the product/service ordered electronically by the Buyer from the Seller's store on FaStart.
- 2.3. The Seller and the Buyer acknowledge and declare that they are aware of and understand their obligations and responsibilities arising from the Law No. 6502 and the Distance Contracts Regulation.
3. Platform Role
- 3.1. FaStart Teknoloji A.S. ('FaStart') acts as an 'intermediary service provider' within the scope of the Law on Regulation of Electronic Commerce No. 6563. FaStart provides e-commerce infrastructure services to Sellers (store hosting, themes, admin panel, integrations).
- 3.2. FaStart is NOT a party to the sales contract between the Buyer and the Seller. All obligations regarding the sale, transfer of ownership, delivery and after-sales services rest exclusively with the Seller.
- 3.3. Payment is processed through the Seller's own payment provider (POS integration) directly to the Seller. FaStart does NOT collect payments from Buyers, does not act as a payment intermediary and plays no role in the payment flow.
- 3.4. The only fees FaStart collects from the Seller are platform subscription fees and commissions; these do not concern the Buyer.

5. Payment
- 5.1. Payment is processed through the Seller's own payment provider (POS) integrated with the FaStart platform. The Buyer pays the Seller directly.
- 5.2. All prices are in Turkish Lira and inclusive of VAT.
- 5.3. FaStart plays no role in payment collection. FaStart does not provide payment intermediary services.
- 5.4. For payment-related issues (refunds, cancellations, chargebacks), the responsible parties are the Seller and the Seller's payment provider.
6. Delivery
- 6.1. Packaging, dispatching and delivering the product is exclusively the Seller's responsibility.
- 6.2. The Seller is obliged to deliver the product intact, complete and free of defects within the time stated in the order confirmation.
- 6.3. Shipping is carried out through the carrier chosen by the Seller.
- 6.4. The maximum legal delivery period is 30 (thirty) days. If delivery cannot be made within this period, the Buyer may terminate the contract.
7. Right of Withdrawal
7.1. The Buyer may exercise the right of withdrawal within 14 (fourteen) days from delivery without any justification or penalty, pursuant to Article 48 of Law No. 6502 and the Distance Contracts Regulation.
7.2. The notice of withdrawal shall be made via the 'Request / Complaint' form on the FaStart platform or by written notice to the Seller.
7.3. Return shipping costs are determined per the Seller's policy. The Seller is obliged to refund the product price to the Buyer within 14 (fourteen) days from the date the withdrawal notice is received.
8. Withdrawal Exceptions
The right of withdrawal cannot be exercised in the following cases pursuant to Article 15 of the Distance Contracts Regulation:
- Goods or services the price of which varies depending on fluctuations in financial markets
- Goods prepared or produced in line with the consumer's requests or personal needs
- Goods liable to deteriorate or expire rapidly
- Goods whose protective elements (packaging, tape, seal) have been opened after delivery and whose return is unsuitable for health or hygiene reasons
- Goods that have been mixed with other items after delivery and cannot be separated by their nature
- Books, digital content and computer consumables presented on physical media whose protective elements have been opened after delivery
- Periodicals such as newspapers and magazines supplied under a subscription
- Services related to accommodation, goods transport, car rental, food-beverage supply, and leisure activities that must be performed on a specific date or period
- Services performed instantly in electronic environment or intangible goods delivered instantly to the consumer
- Services whose performance has commenced before the expiry of the withdrawal period with the consumer's consent
9. Force Majeure
Events that are unforeseeable, beyond the control of the parties and that make performance partially or completely impossible are considered force majeure (natural disasters, war, strikes, epidemics, government acts, infrastructure failures, etc.). Obligations of the parties are suspended during force majeure.
10. Competent Authority
- For disputes up to the monetary threshold announced annually by the Ministry of Trade: Consumer Arbitration Committees at the Buyer's or Seller's place of residence
- For disputes exceeding the monetary threshold: Consumer Courts shall have jurisdiction
11. Effective Date
This Agreement is concluded and enters into force upon the Buyer's electronic approval. The agreement text was last updated on 23.02.2026.
